1. The purpose of the Online Terms and Conditions
The Customer (hereinafter referred to as the “Customer”) is a legal or natural person who has entered into Agreement with Tampere Water (for instance, a water supply agreement). These terms and conditions will be applied to the contractual relationship between Tampere Water (hereinafter referred to as “Tampere Water”) and the Customer that applies to the Customer’s right to use the electronic services provided by Tampere Water (hereinafter referred to as the “Online Services”). The aforementioned parties, Tampere Water and the Customer, will be referred to together as “the Contractual Parties”.
2. The Online Service
The Online Services refers to the online services maintained by Tampere Water that can be used after this registration. The Customer accepts that the username or password or other identification method accepted by the service required to log in to the service are equivalent to the Customer’s signature. In the Service, the Customer can view and bindingly change certain matters related to agreements, accept agreements and submit alteration requests related to them as well as order services to the extent that is possible in the Online Service at the time. When registering for the Service, the Customer accepts that electronic message transmission in accordance with the General Terms and Conditions of Tampere Water may be applied to the customer, and that Tampere Water may electronically submit different contractual documents, terms and conditions, reports (for instance, consumption reports) pursuant to legislation, decrees, other regulations or contractual terms and conditions in the Online Service or otherwise using electronic message transmission if the aforementioned legislation, decrees, other regulations or contractual terms and conditions allow it. Tampere Water does not charge the Customer anything for opening or using the service unless otherwise agreed upon by the Customer and Tampere Water for the use of certain services.
3. Username and password
Upon registration, the Customer will receive a personal username and password for the Online Service. The Customer commits to storing them carefully and keeping them to themselves. The Customer is responsible for the username and password not falling in the wrong hands. The Customer is responsible for all use carried out with their username and password and any possible caused damage and costs. If the Customer has reason to suspect that their username has been misplaced or ended up in the hands of a third party, this must be immediately reported to the user support that will remove any possible rights related to the username and password during the opening hours of Tampere Water’s user support as soon as possible taking into account their workload.
4. Customer obligations
The Customer is responsible for the validity of the information provided through the Online Service. The Customer is responsible for all actions conducted in the Service with valid user credentials. The content of messages and the conducted actions in the Service are seen as having been stored in the service provider’s data system. The provided data is binding for the Customer. If there are any errors in the submitted data or the data is destroyed, the Customer must provide new data upon request. If the Customer notices or suspects an error in the Online Service, they must suspend their use of the service and report the error without delay to Tampere Water. The Customer may resume their use of the Service once they have received a notification of the error having been resolved.
5. Access rights of a representative authorised by the Customer
The Customer may authorise another company or person to use the Services described in these Terms and Conditions if the authorised party accepts these Terms and Conditions and commits to complying with them. The authorisation is seen to signify an authorisation to handle all of the services provided by the Customer’s Online Service through the Online Service as specified in these Terms and Conditions. The Customer/authorised party is obligated to notify the user support immediately if the authorisation ceases.
6. Data privacy
The Customer and Tampere Water are responsible for their own data systems and their appropriate data privacy. The Contractual Parties are for their own part responsible for sufficiently careful processing of personal data in accordance with the valid legislation. Tampere Water is not responsible for any damage caused by data privacy risks (for instance, computer viruses) to the Customer. Tampere Water is not responsible for the damage possibly caused to the Customer by data getting lost or changing in the information network.
7. User Support
User Support advises the Customer in all questions related to using the Service. User Support is open during the opening hours of Tampere Water’s Customer Service. User Support: vesi.asiakaspalvelu@tampere.fi.
8. Usability and the right to suspend the service
The use of the Online Service and any known exceptions to the Service’s use are notified on the login page of the Online Service. Tampere Water reserves the right to temporarily suspend the Online Service if it is indispensable for the Online Service, its technical changes or renewal or due to general information network installation, alteration and maintenance work. Tampere Water has the right to suspend providing the services by temporarily or permanently shutting down the user connection, for instance, if the Customer does not comply with these Terms and Conditions or if there is reason to suspect that the service is being used in a way that may damage the Contractual Parties or third parties. Tampere Water aims to keep the downtime as short as possible and to schedule it to a time and so that it would cause as little inconvenience as possible. Any possible disruptions and defects in the Online Service will be fixed during the opening hours of the User Support and as soon as is possible, taking into account the User Support’s workload. Should a change in the Online Service cause a discontinuation, Tampere Water aims to minimise any damage to the Customer and will take any actions it sees fit. Tampere Water is not responsible for any damage caused by the above-mentioned actions. Should Tampere Water carries out any alteration or maintenance work, Tampere Water is not responsible if the technical equipment of the Customer must be adjusted or otherwise adapted or if it no longer is sufficient for conducting or using the Online Service or if any other consequences are observed in the Customer’s technical equipment as a result of this work.
9. Data connection costs
The Customer is responsible for all the costs caused by acquiring and maintaining all equipment and data connections required to use the Service. The Customer is responsible for the data connection costs until the data connection systems of Tampere Water.
10. Service-related rights
The ownership authorisation and copyrights of the Online Service and the materials contained in it belong to Tampere Water or a third party.
11. Force majeure
Tampere Water is not responsible for any damage caused by a force majeure or a similar reason that hinders the companies’ operations unreasonably. In addition to a traditional understanding of a force majeure, it also includes disruptions in the supply of electricity, cable connections or data connections, a disruption in information processing or telecommunications, data transfer or other method of electronic communication or similar.
12. Limitation of liability in case of damages
Tampere Water is not responsible for any possible damage caused by a disruption, delay, error or restricted use of the service, the user credentials not working or any other reason related to the use or functionality of the service.
13. Applicable law and the settlement of disputes
Finnish legislation will be applied to these Terms and Conditions. Any disputes regarding these Terms and Conditions will be settled in the Pirkanmaa District Court.
14. Changing the Online Service and the Terms and Conditions
The service is being continuously developed. Tampere Water reserves the right to change the content of these Terms and Conditions, service offering, user instructions, operations related to information technology or the design of the service without notifying the Customer separately. If the Customer does not accept the completed change, the Customer and Tampere Water have the right to terminate the access right to the Online Service. If the Customer uses the services described in these Terms and Conditions after the change has become valid, it is understood that the Customer has accepted the change.
15. Validity and termination of the agreement
For the Customer, the access right of the Online Service will become valid once the Customer has accepted these Terms and Conditions and completed the necessary information for opening the Online Service on the website and registered for the Online Service. After the registration, the Customer’s access right is valid for now. The Customer’s access right to the Online Service will terminate no later than a month after the agreement or the agreement period between the Customer and Tampere Water is terminated. Each Contractual Party has the right to terminate the access right to the Online Service immediately without a separate period of notice. Tampere Water reserves the right to remove the Customer’s username from their register if it is left unused for more than six months.
